Since 1992, Scott has focused his practice on providing clients with negotiated or litigated solutions in commercial disputes. He represents lenders, creditors, borrowers, landlords, guarantors, and debtors in all aspects of commercial insolvency law. Scott works with clients in the loan workout and business turnaround stage outside of court proceedings, as well as providing representation in the United States Bankruptcy Court and state court proceedings in liquidations, Chapter 11 reorganizations, receiverships, and commercial lawsuits in state and federal court. At each stage of a legal problem, Scott provides spirited and focused representation of his clients’ interests.

Mr. Cohen is Board Certified by the American Board of Certification in Business Bankruptcy, AV rated by Martindale- Hubbell®, a member of the Maricopa County Bar Association, Arizona State Bar Association, California Bar Association, Turnaround Management Association, and American Bankruptcy Institute. Author of numerous articles on bankruptcy and creditor rights, Scott is also a Contributing Editor to Norton’s Bankruptcy Law and Practice (3rd Edition) and was recently voted as a Southwest Super Lawyer in 2008.

Mr. Cohen is admitted to practice before all state and federal courts in Arizona, California, and before the Ninth Circuit Court of Appeals.

Mr. Cohen earned his Juris Doctor degree from the University of Iowa College of Law, with distinction, in 1992, where he was on the Iowa Law Review. He earned his undergraduate degree in Political Science from the University of Iowa in 1989. Mr. Cohen is a frequent speaker at seminars on bankruptcy law, fraudulent transfers, preferences, and related topics.

Illustrative of his representations, are the following:
  • Represented a regional hospital and other out-of-network providers in an involuntary bankruptcy of a third party administrator plan that was wholly-owned by another regional hospital, and then worked with his client in the client’s role as Chair of the Unsecured Creditors’ Committee to collaborate with debtor’s counsel to confirm a full-payment, Chapter 11 reorganization plan.

  • Represented a REIT in publicly traded, private school Chapter 11 reorganization case involving multiple locations and a buyback by the parents.

  • Represented an Unsecured Creditors’ Committee in a currency exchange bankruptcy case involving fraud allegations against the debtor and different fraud allegations against a large European bank.
