Scott Hulbert focuses his practice on reaching creative business
solutions for clients faced with challenging commercial, construction, and environmental litigation matters. Scott joined Engelman Berger in 2008 after practicing with two of Arizona’s largest firms. He has represented business owners, general contractors, subcontractors, mortgage brokers, mortgage lenders, residential developers, commercial developers, and real estate investors in a variety of actions before federal, state, and administrative courts and agencies. He is active in the firm’s commercial litigation and natural resources practices.
Scott is experienced in all aspects of the litigation process. At each stage of the process, he counsels clients on the best and most cost effective approach to reaching their goals. Although not hesitant to fully contest a matter thorugh the trial stage, Scott recognizes the need to explore other resolution options such as mediation or settlement when the best business solution for a client is something short of trial.
Mr. Hulbert is a member of the Arizona State Bar Association, the Maricopa Bar Association, the American Bar Association, and the Arizona Association of Defense Counsel. Mr. Hulbert is admitted to practice before all state and federal courts in Arizona. He has also represented clients before state and federal agencies, including the Arizona Registrar of Contractors.
Mr. Hulbert earned his Juris Doctor degree, cum laude, from Vermont Law School in 2002. Vermont Law is consistently ranked as one of the top environmental law schools in the United States. He earned his Master of Public Administration and a certificate in Environmental Law and Policy from the University of Colorado in
2000. Mr. Hulbert’s undergraduate degree is in Political Science from Transylvania University, where he also qualified as an All-American on the swim team.
Mr. Hulbert is in his second term as the Chair of Theater Works’ Board of Directors. Theater Works is a non-profit theater charged with the management of the Peoria Center for the Performing Arts. Theater Works provides community and children theater programming and education to the West Valley.
Representative cases include:
- Represented a client in federal regulatory matters addressing CERCLA remediation and cost recovery actions as they relate to the EPA, the Arizona Department of Environmental Quality, and several potential responsible parties.
- Represented a large land developer in separate actions brought by the United States and Arizona alleging violations of federal regulatory laws including the Clean Water Act, the Endangered Species Act, and Arizona statutes including the Native Plant Act and the Aquifer Protection Act.
- Represented residential developers in a variety of civil and commercial matters before state court and the Arizona Registrar of Contractors.
- Represented corporate managers in a multi-million dollar fraud action against the officers and directors of a mortgage lending company.
- Represented a corporate executive in a lawsuit involving the alleged breach of an employment agreement, violation of noncompete and non-disclosure provisions, and improper use of trade secrets.
- Handled the day-to-day defense of an environmental remediation company in a multi-million dollar case involving the alleged total loss of an exclusive mansion in Paradise Valley, Arizona.
