Tom Nolasco joined Engelman Berger in 2010, bringing to the firm his substantial commercial litigation experience gained as a partner for a large Phoenix law firm. Tom's commercial litigation experience includes a variety of disputes on business issues, including contract disputes, commercial lease disputes, trademark / copyright infringement, and enforcement or defense of restrictive covenants in the employment, franchise and other contexts. Tom has extensive expertise in cases involving defense of accountants and other business professionals in professional liability cases.
Specific examples of Mr. Nolasco's representations include the following:
- Prosecuted and obtained trial verdict in favor of commercial real estate developer against contractor, including dismissal of contractor's counterclaim for breach of contract.
- Successfully defended developer in a 7-figure copyright infringement action arising out of an architect's claim to ownership of model home plans.
- Enforced landord's rights against defaulting tenants, including lock-out and forcible detainer trials of shopping center tenants.
- Successfully defended officers/directors from individual liability on fraud claims asserted by a manufacturer in a 7-figure breach of contract dispute.
- Successfully defended former employees in a 7-figure restrictive covenant action related to the employees' commencement of work at a competitor's business.
- Successfully defended accountant in a 7-figure accounting malpractice action.
Mr. Nolasco serves as the accounting malpractice chair of the Professional Liability Defense Federation. He will deliver a presentation on accounting liability at the Fall 2010 Annual Meeting. In addition, he was a Speaker on “Enforcement of Foreign Judgments in the United States” at the CILS International Litigation Seminar, February 2007, and a Speaker on “Personal Jurisdiction over Parties to Internet Transactions,” at the Arizona State Bar Convention, June 2005. Mr. Nolasco also served on the Board of Directors for All-Star Kids Tutoring, a charitable foundation that provides literacy skills for underprivileged children.
Mr. Nolasco is admitted to practice in the state and federal courts in Arizona and Wisconsin. He received his law degree from Marquette University Law School, where he was a Dean's List honoree, and his M.B.A. from Thunderbird, The School of Global Management. He received his undergraduate degree from DePauw University and previously attended the London School of Economics and Political Science. He has worked in the banking and finance field prior to his law career.
